В настоящей статье необходимая оборона рассматривается как обстоятельство, исключающее преступность деяния. Анализируется законодательство в сфере "самообороны", в частности предложено совершенствовать постановление Пленума Верховного суда РФ от 27.09.2012 N 19 "О применении судами законодательства о необходимой обороне и причинении вреда при задержании лица, совершившего преступление".
The article considers aspects of the normative transformation of the status of a foreign agent in the Russian Federation. Legal gaps have been identified in the interpretation of the status of a "foreign agent" itself, as well as the terms "foreign influence" and "foreign source" related to it. The criteria for recognition and forms of activity for securing this status for them are defined.

С появлением нового государственного органа - конституционного совета в субъектах РФ, канула в лету существенная правовая сила, которая осталась незамеченной научным сообществом страны. Данный орган, созданный вместо конституционных (уставных) судов в субъектах РФ, к сожалению, не имеет должных правовых полномочий, в следствие чего, большинство субъектов, имевших конституционные (уставные) суды, воздерживаются учреждать данный орган, что привело к определенному ослаблению роли республик в составе РФ в деле защиты прав и свобод граждан, а также снижению эффективности средств охраны Основного закона субъектов РФ вследствие отсутствия полномочий по разрешению правовых споров. Кроме того, учрежденные конституционные советы у республик имеют разные правовые статусы, вследствие различного подхода законодателей субъектов РФ при учреждении нового органа, что должно было привести к пересмотру правового статуса конституционных советов на федеральном законодательном уровне.
With the emergence of a new state body - the constitutional council in the subjects of the Russian Federation, a significant legal force has sunk into oblivion, which remained unnoticed by the scientific community of the country. This body, created instead of constitutional (charter) courts in the subjects of the Russian Federation, unfortunately, does not have the necessary legal powers, as a result of which the majority of subjects that had constitutional (charter) courts refrain from establishing this body, which has led to a certain weakening of the role of the republics within the Russian Federation in protecting the rights and freedoms of citizens, as well as a decrease in the effectiveness of the means of protecting the Basic Law of the subjects of the Russian Federation due to the lack of powers to resolve legal disputes. In addition, the established constitutional councils in the republics have different legal statuses, due to the different approaches of legislators of the subjects of the Russian Federation when establishing a new body, which should have led to a revision of the legal status of constitutional councils at the federal legislative level.
