Эффективность уголовного судопроизводства, в том числе достижения его назначения, во многом зависит от качества предварительного расследования и деятельности следователя. В соответствии с принципом состязательности он отнесен уголовно-процессуальным законом к стороне обвинения. Отмечено, что вопросы реализации следователем функции обвинения остаются до сих пор дискуссионными. В статье они рассмотрены с точки зрения целей расследования и взаимодействия следователя при его осуществлении со своим руководителем; влияния значительных полномочий руководителя следственного органа по осуществлению ведомственного процессуального контроля на процессуальную самостоятельность следователя, на решение задач объективного расследования уголовного дела и реализацию им функции обвинения. Сделан вывод о закономерной постановке вопроса о необходимости снижения зависимости следователя от руководителя следственного органа, что ограничивает его процессуальную самостоятельность, объективность расследования и достижение, в конечном счете, назначения уголовного судопроизводства.
The effectiveness of criminal proceedings, including the achievement of its purpose, largely depends on the quality of the preliminary investigation and the activities of the investigator. In accordance with the principle of adversarial proceedings, he is attributed by the criminal procedure law to the prosecution. It is noted that the issues of the implementation of the prosecution function by the investigator are still debatable. In the article, they are considered from the point of view of the goals of the investigation and the interaction of the investigator in its implementation with his supervisor; the impact of significant powers of the head of the investigative body to implement departmental procedural control on the procedural independence of the investigator, on the solution of the problems of an objective investigation of a criminal case and the implementation of the prosecution function by him. A conclusion is made about the logical formulation of the question of the need to reduce the dependence of the investigator on the head of the investigative body, which limits his procedural independence, the objectivity of the investigation and the achievement, ultimately, of the purpose of criminal proceedings.
